Driving While Intoxicated and Aggravated Driving While Intoxicated

In New York State, Driving While Intoxicated (DWI) and Aggravated Driving While Intoxicated (Aggravated DWI) are crimes. The penalties are severe. Additionally, the refusal to take a chemical test (breathalyzer) automatically results in a one-year revocation of your license, whether you were driving drunk or not.

DWI laws are complex and confusing. For example, at the conclusion of the arraignment, a Judge is required to suspend your license pending the prosecution of the charges against you under New York State’s Prompt Suspension Law. This results in your right to a special hearing, called a Pringle Hearing. Only an attorney can advise you whether a Pringle Hearing is appropriate in your situation and whether you should ask for one. Additionally, even if your license is suspended pending prosecution, you may be entitled to a hardship license so you can continue to drive to and from work. Again, only your attorney can advise you if a Hardship Hearing should be requested, and only your attorney should conduct that hearing.
