Probate Law – Surrogate’s Court

Surrogate’s Court exists to determine the validity of wills, enforce the requirements of valid wills, prevent malfeasance by executors and administrators of estates, provide for a fair distribution of the possessions and/or property of persons who die intestate (without a valid will), and to verify that creditors of an estate are paid.

Surrogate’s Court may also deal with conservatorships, guardianships, name changes and adoptions.

The Surrogate’s Court can be petitioned by heirs, beneficiaries and creditors of an estate, such as when an heir contests the validity of a will, a beneficiary feels that an estate is being mishandled, or a creditor files a claim against the estate.  The court also has the authority to require the executor to give an accounting of his actions.
