Robert G. Randall, Jr. has practiced in the area of family law since 1975. He has been a law guardian, mediator and matrimonial fee dispute arbitrator. He is a member of the Family Law Sections of both the New York State Bar Association and the Florida Bar.
We, at the Randall Law Firm, are aware that the issues involved in Family matters are sensitive and generally have numerous permutations, especially if children are involved. In New York, the parties must be apprised of the provisions of the New York Child Support Standards Act. We provide each client with a copy of the Act, explain the calculations and review the additional items that may be applicable, such as the costs of daycare, education and medical insurance. If the parties cannot resolve these issues themselves or through mediation or negotiation either the Family Court or Supreme Court has jurisdiction to resolve these issues.
In the context of divorce proceedings, the parties’ marital property is equitably distributed. Case Law and Statutory Law define what constitutes marital property and how to value it. As a general rule, property acquired during the marriage is considered marital property, subject to distribution. This includes pensions, deferred income and IRAs, business interests and advanced degrees. Only Supreme Court, not Family Court, can order the distribution of marital property.
