Robert G. Randall, Jr. has practiced in the area of matrimonial law since 1975. He has been a law guardian, mediator and matrimonial fee dispute arbitrator. He is a member of the Family Law Sections of both the New York State Bar Association and the Florida Bar.
We, at the Randall Law Firm, are aware that the issues involved in Matrimonial matters are sensitive and generally have numerous permutations, especially if children are involved. Typical issues include custody (joint or sole), visitation, scheduling, arranging who provides transportation, relocation issues and child support. In New York, the parties must be apprised of the provisions of the New York Child Support Standards Act. We provide each client with a copy of the Act, explain the calculations and review the additional items that may be applicable, such as the costs of daycare, education and medical insurance. If the parties cannot resolve these issues themselves or through mediation or negotiation either the Family Court or Supreme Court has jurisdiction to resolve these issues.
Matrimonial matters often are resolved by a written agreement, frequently referred to as a Separation Agreement, which is signed and acknowledged by the parties. It becomes their private contract which is usually made part of their judgment of divorce. Entering into an agreement avoids the time and expense of litigation and the related uncertainties of allowing another person (the Judge) to make binding decisions. It is our opinion that written agreements are preferable to litigation. However, there are times that the resolution of a matter cannot be reached by agreement, and litigation is required.
