We provide each client with a copy of the Act, explain the calculations and review the additional items that may be applicable, such as the costs of daycare, education and medical insurance. If the parties cannot resolve these issues themselves or through mediation or negotiation either the Family Court or Supreme Court has jurisdiction to resolve these issues.

Matrimonial matters often are resolved by a written agreement, frequently referred to as a Separation Agreement, which is signed and acknowledged by the parties. It becomes their private contract which is usually made part of their judgment of divorce. Entering into an agreement avoids the time and expense of litigation and the related uncertainties of allowing another person (the Judge) to make binding decisions. It is our opinion that written agreements are preferable to litigation. However, there are times that the resolution of a matter cannot be reached by agreement, and litigation is required.
